DECISION & ORDER ON MOTION

125 Court Street, LLC, Respondent, v Yolande Nicholson, Appellant.

Motion by appellant to consolidate an appeal from an order of the Civil Court of the City of New York, Kings County, entered July 16, 2014 (appeal No. 2014-1557 K C) with an appeal from an order of the same court entered September 19, 2014 (appeal No. 2014-2491 K C). Separate motion by respondent, in effect, for an enlargement of time to serve and file papers in opposition to appellant's motion, and to dismiss the appeals.

Upon the papers filed in support of the motions, it is

ORDERED, on the court's own motion, that appellant's motion and respondent's motion are consolidated for purposes of disposition; and it is further,

ORDERED that appellant's motion is granted, the appeals are consolidated under appeal No. 2014-1557 K C, and the consolidated appeals shall be perfected by March 6, 2015; and it is further,

ORDERED that in the event that the consolidated appeals are not perfected by March 6, 2015, the court, on its own motion, may dismiss the consolidated appeals or respondent may move to dismiss the consolidated appeals on three days' notice; and it is further,

ORDERED that the branch of respondent's motion seeking, in effect, an enlargement of time to serve and file papers in opposition to appellant's motion is granted, and the opposition papers are deemed timely served and filed; and it is further,

ORDERED that the branch of respondent's motion seeking to dismiss the appeals is denied.
