| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from an order of the Supreme Court, Queens County, dated September 10, 2013, for leave to reargue his prior motion for leave prosecute the appeal pursuant to 22 NYCRR 670.15, which was determined by decision and order on motion of this Court dated July 15, 2014, or, alternatively, for leave to prosecute the appeal on the original papers.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to reargue is granted, and, upon reargument, the decision and order on motion of this Court dated July 15, 2014, is recalled and vacated, the prior motion for leave prosecute the appeal pursuant to 22 NYCRR 670.15 is granted, and the appeal is deemed submitted on the motion papers filed in connection with this motion, the prior motion, and the papers filed in the Supreme Court, Queens County; and it is further,
ORDERED that the motion is otherwise denied as academic.
