| DECISION & ORDER ON MOTION |
Appeal by 390 Castleton Funding Corp. from an order of the Supreme Court, Richmond County, dated April 11, 2014. By decision and order on motion of this Court dated November 14, 2014, as amended November 17, 2014, enforcement of the order dated April 11, 2014, was stayed pending hearing and determination of the appeal on condition that the appeal was perfected on or before December 15, 2014, and the appellant's time to perfect the appeal was enlarged until December 15, 2014. The appellant has not perfected the appeal.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.8[e][1]) and prior order of the Court, and the stay granted by the decision and order on motion of this Court dated November 14, 2014, as amended November 17, 2014, is vacated forthwith.
