SCHEDULING ORDER

Appeal by Heather C. from an order of the Family Court, Suffolk County, dated September 13, 2013. Pursuant to § 670.4(a)(2) of the rules of this Court (see 22 NYCRR 670.4[a][2]) and a decision and order on motion of this Court dated October 24, 2014, it is

ORDERED that on or before February 13, 2015, the respondent-appellant shall serve and file the replacement brief for the appellant in the above-entitled appeal; and it is further,

ORDERED that in the event the appellant's replacement brief raises an issue concerning the constitutionality of a statute of the State of New York, the respondent-appellant shall serve upon the Attorney General a copy of the appellant's replacement brief, as required by CPLR 1012(b) and Executive Law § 71, as well as copies of the decision and order on motion of this Court dated October 24, 2014, and this scheduling order; and it is further,

ORDERED that within 10 days of service upon him of a copy of the replacement brief, the Attorney General shall notify this Court in writing whether he intends to intervene on this appeal.
