| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by David B. Jacobs for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Jacobs was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 20, 1979, under the name David Barnett Jacobs. By opinion and order of this Court dated March 8, 1993, Mr. Jacobs was suspended from the practice of law for a period of three years based on five charges of professional misconduct (Matter of Jacobs, 188 AD2d 228). Reargument of the opinion and order dated March 8, 1993, was denied by decision and order on motion of this Court dated May 17, 1993. By decision and order on motion of this Court dated October 29, 1996, Mr. Jacob's first motion for reinstatement was denied. By decision and order on motion of this Court dated July 15, 2005, his second motion for reinstatement was denied.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied.
We find that Mr. Jacobs does not demonstrate the requisite fitness and character to practice law.
