DECISION & ORDER ON MOTION

Motion by the respondents Orange County Sheriff's Office and Orange County Sheriff's Office-Pistol Permit Unit to dismiss a proceeding pursuant to CPLR article 78 insofar as asserted against them, inter alia, on the ground of lack of personal jurisdiction.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to dismiss the proceeding insofar as asserted against the respondents Orange County Sheriff's Office and Orange County Sheriff's Office-Pistol Permit Unit on the ground of lack of personal jurisdiction is granted, and the proceeding is dismissed insofar as asserted against the respondents Orange County Sheriff's Office and Orange County Sheriff's Office-Pistol Permit Unit, without costs or disbursements (see CPLR 3211[a][8]); and it is further,

ORDERED that the motion is otherwise denied as academic.
