DECISION & ORDER ON MOTION

Motion by the respondent for leave to reargue an appeal from an order of the Supreme Court, Suffolk County, dated December 11, 2012, which was determined by decision and order of this Court dated August 27, 2014, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court. Cross motion by the appellant to impose a sanction upon the respondent, to clarify the decision and order of this Court dated August 27, 2014, and to direct the respondent to comply with the decision and order of this Court dated August 27, 2014.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that the branch of the cross motion which is to impose a sanction upon the respondent is denied; and it is further,

ORDERED that the branch of the cross motion which is to direct the respondent to comply with the decision and order of this Court dated August 27, 2014 is denied without prejudice to seeking relief in the Supreme Court, Suffolk County; and it is further,

ORDERED that the cross motion is otherwise denied.
