An appeal having been taken herein from an order of the Family Court, Niagara County, entered in the Office of the Clerk of said Court on July 18, 2014, and respondent-appellant having moved for an extension of the stay granted by order of this Court entered October 21, 2014, and for an extension of time to perfect,
Now, upon reading and filing the affirmation of A. Angelo DiMillo, Esq., dated January 5, 2015, the notice of motion with proof of service thereof, and the affirmation of Melissa A. Cavagnaro, Esq., dated January 13, 2015, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that petitioner-respondent is enjoined from enforcing the order of Family Court, Niagara County, entered July 16, 2013, pending the determination of the appeal, on condition that the appeal is perfected on or before March 23, 2015, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect is dismissed as premature (see 22 NYCRR 1000.13 [f]).
