DECISION & ORDER ON MOTION

Motion by MGSH Properties, Inc., inter alia, to dismiss an appeal from an order of the Supreme Court, Kings County, dated March 24, 2014, as untimely taken.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted to the extent that the appeal is dismissed, without costs or disbursements, insofar as taken against MGSH Properties, Inc. (see CPLR 5513[a]), and it is further,

ORDERED that the branch of the motion which is to dismiss the appeal insofar as taken against the respondent Eric Thompson is dismissed as MGSH Properties, Inc., lacks standing to seek that relief.
