| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Rockland County, dated April 14, 2014, on the ground that the record is inadequate, or alternatively, to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied on condition that on or before March 6, 2015, the appellant serve and file a supplemental record containing all of "the papers and other exhibits upon which the . . . order was founded" (see CPLR 5526) which are not contained in the record filed with this Court on November 26, 2014; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until April 6, 2015, and the respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that the motion is otherwise denied.
