| DECISION & ORDER ON MOTION A) |
Motion by the appellant to stay enforcement of an order of the Family Court, Westchester County, dated January 23, 2015, pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion is granted, and enforcement of the order is stayed, care and custody of the subject child shall continue with the appellant, and visitation shall be in accordance with any orders in effect before the order dated January 23, 2015, was issued, pending hearing and determination of the appeal, on condition that the appeal is perfected on or before April 10, 2015; and it is further,
ORDERED that in the event the appeal is not perfected on or before April 10, 2015, the Court, on its own motion, may vacate the stay, without further notice, or the respondents may move to vacate the stay, on three days notice.
