| DECISION & ORDER ON MOTION |
Motion by the appellants on an appeal from a judgment of the Supreme Court, Rockland County, dated May 8, 2013, inter alia, in effect, to calendar this appeal on the same day as appeals pending under Appellate Division Docket Nos. 2012-08347, 2012-08384, 2012-08614, 2012-11030, 2012-10582, 2012-10588, 2013-06057, and 2013-06058. Separate motion by the respondent Scenic Development, LLC, to enlarge its time to serve and file a brief.
Upon the papers filed in support of the appellants' motion and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the motion by the respondent Scenic Development, LLC, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion of the respondent Scenic Development, LLC, is granted, the movant's time to serve and file a brief is enlarged until March 12, 2015, and the movant's brief must be served and filed on or before that date; and it is further,
ORDERED that the branch of the appellants' motion which is to calendar the appeals together is denied as unnecessary in light of the decision and order on motion of this Court in Matter of Shapiro v Town of Ramapo (Appellate Division Docket No. 2012-08347), dated June 24, 2013; and it is further,
ORDERED that the appellants' motion is otherwise denied.
