DECISION & ORDER ON MOTION

Motion by Rhonda Lewis, successor executor of the estate of Phyllis Arons, on an appeal from an order of the Supreme Court, Richmond County, dated June 21, 2011, inter alia, to be substituted for the respondent Manuel Arons, deceased executor of the estate of Phyllis Arons,

and, in effect, to substitute herself and Michelle Gaines, as administrators of the estate of Manuel Arons for the deceased respondent Manuel Arons, and to amend the caption accordingly.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to substitute Rhonda Lewis, successor executor of the estate of Phyllis Arons for the respondent Manuel Arons, deceased executor of the estate of Phyllis Arons, and, in effect, to substitute herself and Michelle Gaines, as administrators of the estate of Manuel Arons for the deceased respondent Manuel Arons, and to amend the caption accordingly, is granted; Rhonda Lewis, successor executor of the estate of Phyllis Arons, is substituted for the respondent Manuel Arons, deceased executor of the estate of Phyllis Arons, and Rhonda Lewis and Michelle Gaines, as administrators of the estate of Manuel Arons, are substituted for the deceased respondent Manuel Arons, and the caption is amended accordingly; and it is further, ORDERED that the motion is otherwise denied.
