SCHEDULING ORDER

On the Court's own motion, it is

ORDERED that the scheduling order of this Court dated February 20, 2015, in the above-entitled case is recalled and vacated, and the following scheduling order is substituted therefor:

Appeal by Heather C. from an order of the Family Court, Suffolk County, dated September 13, 2013. Pursuant to § 670.4(a)(2) of the rules of this Court (see 22 NYCRR 670.4[a][2]), it is

ORDERED that the respondent-appellant's time to serve and file a replacement brief on the appeal is enlarged until March 13, 2015; and it is further,

ORDERED that no further enlargement of time shall be granted; and it is further,

ORDERED that in the event the respondent-appellant's replacement brief raises an issue concerning the constitutionality of a statute of the State of New York, the respondent-appellant shall serve upon the Attorney General a copy of the respondent-appellant's replacement brief, as required by CPLR 1012(b) and Executive Law § 71, as well as copies of the decision and order on motion of this Court dated October 24, 2014, and this scheduling order; and it is further,

ORDERED that within 10 days of service upon him of a copy of the replacement brief, the Attorney General shall notify this Court in writing whether he intends to intervene in this appeal.
