Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from the judgments of the Monroe County Court, rendered September 11, 2014,

Now, upon reading and filing the affidavit of Joshua Krick sworn to January 23, 2015, the notice of motion with proof of service thereof, the statement of Daniel Gross, Esq. dated February 17, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal dated December 7, 2014, which was served upon the Monroe County District Attorney's Office on December 7, 2014 and filed at the Monroe County Clerk's Office on December 10, 2014 is hereby deemed timely served and filed, and

It is further ORDERED that the pro se notice of appeal dated December 7, 2014 shall be treated as valid as to the judgment rendered under indictment No. 2014-0688, (Appellate Division Docket No. KA 15-00227), pursuant to CPL 460.10(6).
