DECISION & ORDER ON MOTION

Motion by the respondent to dismiss appeals from two judgments of the County Court, Westchester County, both rendered April 25, 2007, for failure to timely perfect.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied as unnecessary in light of the decision and order on motion of this Court dated September 25, 2007, which denied the appellant's motion pursuant to CPL 460.30 to extend the time to take appeals from the judgments.
