DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78 in the nature of mandamus. By decision and order on motion of this Court dated July 25, 2014, the Court denied the petitioner's motion for leave to prosecute the proceeding as a poor person, and directed the petitioner to pay the filing fee within 120 days. The petitioner has not paid the filing fee.

Now, on the Court's own motion, it is

ORDERED that the proceeding is dismissed (see CPLR 1101[d]), without costs or disbursements.
