DECISION & ORDER ON APPLICATION

The People of the State of New York, Respondent, v Kenneth Stepney, Appellant.

Application by Barry Jay Skwiersky, Esq., counsel assigned to represent appellant on an appeal from an order of the City Court of Mount Vernon, Westchester County, entered August 17, 2011, which appeal was determined by decision and order of this court dated February 17, 2015, in effect, to be relieved, on the ground of disability, of the assignment and for the assignment of new counsel for the purposes of making a motion for leave to appeal to the Appellate Division, Second Judicial Department, from the decision and order of this court dated February 17, 2015.

Upon the papers filed in support of the application and no papers having been filed in opposition or in response thereto, it is

ORDERED that the application is granted and Barry Jay Skwiersky, Esq., is relieved of the assignment and directed to turn over all papers to counsel herein assigned; and it is further,

ORDERED that JOHN PAUL SAVOCA, ESQ., P.O. BOX 531, YORKTOWN HEIGHTS, NEW YORK 10598 is assigned pursuant to article 18-B of the County Law; and it is further,

ORDERED that newly assigned counsel is directed, within 10 days from the date of this decision and order on motion, to serve a copy thereof upon appellant pursuant to CPLR 2103 (b) (1) or (2), and (c), and to file proof of such service in the office of the Clerk of this court within five days thereafter, which service shall constitute notice to appellant to appoint a new attorney pursuant to CPLR 321 (c).
