It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that landlord-appellant's motion and tenant-respondent's cross motion are granted to the extent of deeming the appeal to be withdrawn. That portion of landlord-appellant's motion seeking to release the appellate bond is denied without prejudice to landlord-appellant's right to pursue appropriate legal measures to obtain a release of the funds secured by the appeal bond.
