In the Matter of Douglas Klein, respondent,

v Sirota Survey Intelligence, LLC, et al., appellants.

(Index No. 7343/14)

DECISION & ORDER ON MOTION

Appeal by Sirota Survey Intelligence, LLC, Michael Meltzer, and J. Nicholas Starritt from an order of the Supreme Court, Nassau County, dated October 2, 2014. The notice of appeal was filed in the Office of the Westchester County Clerk. By order to show cause dated December 2, 2014, the parties were directed to show cause why the appeal should or should not be dismissed on the ground that the notice of appeal was not filed in the Office of the Nassau County Clerk.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see CPLR 5515[1]); and it is further

ORDERED that the appellants' time to file the notice of appeal in the Office of the Nassau County Clerk is extended until April 27, 2015 (see CPLR 5514[a]).
