DECISION & ORDER ON MOTION

Motion by the appellants to stay the respondent, or anyone acting on its behalf, from taking any action to terminate their leases or tenancies, and from commencing summary eviction proceedings or taking other action to evict them or interfere with their possession of the subject premises, pending hearing and determination of an appeal from an order of the Supreme Court, Kings County, dated January 29, 2015.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and the respondent, or anyone acting on its behalf, is stayed from taking any action to terminate the appellants' leases or tenancies, and from commencing summary eviction proceedings or taking other action to evict them or interfere with their possession of the subject premises located at 59 North 3rd Street, also known as 241 Bedford Avenue, also known as 160 N. 4th Street, Brooklyn, New York, pending hearing and determination of the appeal on condition that (1) the appeal is perfected on or before April 27, 2015, and (2) the appellants pay rent in accordance with the subject leases; and it is further,

ORDERED that in the event the appellants do not comply with the foregoing conditions, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
