The People of the State of New York, Respondent, v Eugene Agbimson, Appellant.

Motion by respondent to strike the appellant's brief and dismiss an appeal from a judgment of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered May 8, 2014, or, in the alternative, to resettle the trial transcript.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to strike the appellant's brief and dismiss the appeal is denied; and it is further,

ORDERED that the branch of the motion seeking to resettle the trial transcript is denied without prejudice to respondent moving for that relief in the District Court.
