| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by James J. Quail for reinstatement to the Bar as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 12, 2000, under the name James Joseph Quail. By opinion and order of this Court dated September 29, 2009, the respondent was suspended from the practice of law for a period of five years (see Matter of Quail, 68 AD3d 16).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Mr. Quail's current character and general fitness to practice law including, but not limited to, inquiry into his current mental health status, the nature of his current employment, any pending litigation, including the foreclosure action in which he is named as a third-party defendant and the matter concerning the 2011 deed in lieu of foreclosure resulting from the 2008 foreclosure of a mortgage on rental property owned by him, proof of restitution, and his tax returns for years 2009 through 2012.
