| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from an order of the County Court, Suffolk County, dated April 4, 2014, issued pursuant to CPL 440.46, to determine the appeal without the benefit of the respondent's brief on the ground that the respondent failed to timely serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the Clerk of this Court, or her designee, shall serve a copy of the appellant's brief on the respondent on or before April 15, 2015; and it is further,
ORDERED that the respondent shall serve and file its brief on or before June 15, 2015; and it is further,
ORDERED that the motion is denied.
