Neilan Stern, Appellant-Respondent, v Lawrence Levine, Respondent-Appellant.

Motion by appellant-respondent on an appeal from a decision of the Civil Court of the City of New York, Kings County, dated November 12, 2013, in effect, to continue a stay granted by decision and order on motion of this court dated April 9, 2014, and to compel respondent-appellant to provide appellant-respondent with a copy of the file. Cross motion by respondent-appellant to vacate the stay and dismiss the appeal, or for alternative relief.

Upon the papers filed in support of the motion and cross motion, and the papers filed in opposition thereto, it is

ORDERED that respondent-appellant's cross motion is granted and the appeal is dismissed on the ground that no appeal lies from a decision (see CCA 1702); and it is further,

ORDERED that appellant-respondent's motion is denied.
