Appeal from a judgment of conviction of the Justice Court of the Town of Eastchester, Westchester County, rendered October 7, 2009.
On the court's own motion, and upon the death of appellant on June 24, 2014, it is
ORDERED that the appeal is dismissed and the matter is remitted to the Justice Court for entry of an order vacating the judgment of conviction and dismissing the accusatory instrument pursuant to People v Mintz (20 NY2d 770 [1967]).
