It is Ordered that plaintiff-respondent's motion is granted without opposition, only to the extent of dismissing the appeal. That portion of plaintiff-respondent's motion that seeks the release of funds is denied without prejudice to plaintiff-respondent renewing said motion and presenting proof that defendant-appellant did in fact deposit monies with the Finance Administrator of the City of New York in connection with this case.
