Separate motions by the respondents Commack Union Free School District, James A. Feltman, Commack School District Board of Education, Mary Jo Masciello, Joseph Pennacchio, Deborah Guber, Allen Leon, and Thomas L. Tornee, and the respondent Sebastian DiRubba to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated August 28, 2014, on the ground that no appeal lies from an order denying reargument. Application by the appellant to withdraw the appeal.
Upon the papers filed in support of the motions and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the appeal is deemed withdrawn, without costs or disbursements; and it is further,
ORDERED that the motions are denied as academic.
