Petitioner having moved for permission to file and serve one copy of the brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Cayuga on February 27, 2015, and for other relief,

Now, upon reading and filing the affidavit of Manuel Martinez sworn to March 23, 2015, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion for permission to proceed on one brief is denied (see 22 NYCRR 1000.8 [b] [1]), and

It is further ORDERED that the motion for an extension of time to file and serve petitioner's briefs is granted to the extent that petitioner shall filed and serve briefs on or before May 26, 2015, and, in the event of a failure to file and serve the briefs, the petition is dismissed without further order, and

It is further ORDERED that respondent shall file and serve briefs on or before July 6, 2015.
