DECISION & ORDER ON MOTION

Appeal by Robert Brisken from an order of the Supreme Court, Queens County, dated January 20, 2015. By order to show cause dated March 5, 2015, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the order dated January 20, 2015, is not appealable either as of right or by permission (see CPL 450.10; 450.15).

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion is granted and the appeal is dismissed, without costs or disbursements (see CPL 450.10; 450.15).
