DECISION & ORDER ON MOTION

Appeal by Arthur Strugatch from an order of the Family Court, Westchester County, dated July 22, 2014. By decision and order on motion dated March 17, 2015, the appellant's time to comply with the scheduling order dated September 24, 2014, was extended until April 17, 2015. The appellant has failed to comply with the scheduling order.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the scheduling order dated September 24, 2014 (see 22 NYCRR 670.4[a][2],[4]).
