| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Surrogate's Court, Suffolk County, dated December 19, 2014, for leave to correct, pursuant to CPLR 2001, a mistake in the attachment to the notice of appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the order dated December 19, 2014, and entered in the above-entitled proceeding pending in the Surrogate's Court, Suffolk County, under File No. 1029/06, is deemed to be attached to the notice of appeal in place of the mistakenly attached order, also dated December 19, 2014, which was entered in a proceeding pending in the Surrogate's Court, Suffolk County, under File No. 313/04 (see CPLR 2001).
