Motion by the petitioners-respondents to dismiss an appeal from an order of the Supreme Court, Dutchess County, dated August 11, 2014, on the ground that the right of direct appeal therefrom terminated upon entry of a judgment in the above-entitled proceeding. Separate motion by the appellant to withdraw the appeal.
Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the appellant's motion is granted and the appeal is deemed withdrawn, without costs or disbursements; and it is further,
ORDERED that the petitioners-respondents' motion is denied as academic.
