DECISION & ORDER ON MOTION

Motion by the respondent to strike the appellant's appendix on an appeal from a judgment of the County Court, Dutchess County, rendered March 27, 2014, for failure to file the transcripts of certain proceedings or to direct the appellant to file the complete transcripts of the Huntley hearing, the trial, and the sentencing, and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to direct the appellant to file the complete transcripts of the Huntley hearing, the trial, and the sentencing is granted, and on or before June 18, 2015, the appellant shall file the transcripts of the Huntley hearing, the trial, and the sentencing; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until July 20, 2015, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
