DECISION & ORDER ON MOTION

Motion by the respondent Ken Brown to dismiss an appeal from an order of the Supreme Court, Kings County, dated July 28, 2014, inter alia, for failure to timely perfect. Separate motion by the respondents Catskill Regional Medical Center, Emergency Medical Association of New York, P.C., and Nurse McCoy to dismiss the appeal for failure to timely perfect.

Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion by the respondent Ken Brown which is to dismiss the appeal for failure to timely perfect and the motion by the respondents Catskill Regional Medical Center, Emergency Medical Association of New York, P.C., and Nurse McCoy to dismiss the appeal for failure to timely perfect are granted, and the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules of this Court (see 22 NYCRR 670.8[e]); and it is further,

ORDERED that the motion by the respondent Ken Brown is otherwise denied as academic.
