Motion by the appellant, inter alia, in effect, to recall and vacate a decision and order on motion of this Court dated December 9, 2013, which granted the respondent's motion to dismiss an appeal from a judgment of the Supreme Court, Queens County, rendered November 12, 2009, for failure to timely perfect.
