DECISION & ORDER ON MOTION

Motion by appellant, in effect, to recall and vacate so much of this court's decision and order on motion dated January 6, 2015 as dismissed appellant's appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered November 8, 2013.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, the appeal is reinstated, and appellant is directed to serve and file the appellant's brief within 21 days of the date of this decision and order on motion; and it is further,
ORDERED, on the court's own motion, that so much of this court's decision and order on motion dated January 6, 2015 as denied as academic a motion by Eric T. Schneiderman, Attorney General of the State of New York, for leave to submit a respondent's brief is recalled and vacated, that motion is granted, and the respondent's brief shall be served and filed within 21 days after service of the appellant's brief.
