Appellant having moved for permission to proceed as a poor person on the appeal taken from a judgment of the Monroe County Court rendered January 27, 2015, and for other relief,
Now, upon reading and filing the affirmation of David M. Abbatoy, Jr., Esq. dated April 30, 2015 and the affidavit of Taylor D. Carbonaro sworn April 18, 2015, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the appeal herein may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c) (1) and ten copies of appellant's brief, reproduced in accordance with 22 NYCRR 1000.4 (f), and
It is further ORDERED that defendant is directed to install a GPS monitoring device on his person that will allow the Monroe County Probation Department and the Rocky Mountain Offender Monitoring Service to confirm his precise location at all times, and
It is further ORDERED that if defendant duly installs said GPS monitoring device to the satisfaction of the Monroe County Probation Department and the Rocky Mountain Offender Monitoring Service, he may only attend the medical appointments in the manner thereby referenced in the affirmation of David M. Abbatoy, Jr., Esq. dated April 30, 2015, and
It is further ORDERED that the motion is otherwise denied.
