| DECISION & ORDER ON MOTION |
Motion by the appellant to stay her eviction from the subject premises and to stay all proceedings in a matter pending in the Sixth District Court, Suffolk County, entitled Fannie Mae v Dickerson, under Index No. L & T 1315/14, pending hearing and determination of an appeal from an order of the Supreme Court, Suffolk County, dated October 30, 2014.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the respondent, or anyone acting on its behalf, is stayed from evicting the appellant from the subject premises, located at 29 Creighton Avenue, Brookhaven, New York, and all proceedings in the matter entitled Fannie Mae v Dickerson, pending in the Sixth District Court, Suffolk County, under Index No. L & T 1315/14, are stayed, pending hearing and determination of the appeal on condition that the appeal is perfected on or before July 13, 2015; and it is further,
ORDERED that in the event the appeal is not perfected on or before July 13, 2015, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
