| DECISION & ORDER ON MOTION |
Motion by the appellant to be furnished with certain material on an appeal from a judgment of the County Court, Suffolk County, rendered July 10, 2013. Separate motion by the appellant to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motions, the papers filed in opposition to the motion to be furnished with certain material, and no papers having been filed in opposition or in relation to the motion to enlarge the time to serve and file a brief, it is
ORDERED that the branch of the motion which is to be furnished with the papers filed in support of and in opposition to the appellant's motion pursuant to CPL330.30, with attached exhibits, the order denying the speedy trial motion, photographs admitted as evidence at trial, the 911 tape, all discovery material, reports, victims' statements on videodiscs, redacted incident report, notes of Detective Barbet, lineup and cover sheet and photographs, affidavit of Abit Soylu, and photograph array and prosecution worksheet, defense motions, and transcripts of all waivers is granted to the extent that the Clerk of the Court or her designee shall furnish the appellant with copies of any of the foregoing material which is contained in the original papers on file with the Clerk of the Court, and that branch of the motion is otherwise denied; and it is further,
ORDERED that the branch of the motion which is to be furnished with the transcript of the grand jury proceedings is denied; and it is further,
ORDERED that the motion to enlarge the time to serve and file a brief is granted, the appellant's time to serve and file a brief is enlarged until August 28, 2015, and the appellant's brief must be served and filed on or before that date.
