DECISION & ORDER ON MOTION

Motion by the appellant pro se to extend his time to make a motion for leave to appeal to the Court of Appeals from a decision and order of this Court dated January 14, 2015, which determined an appeal from a judgment of the Supreme Court, Nassau County, rendered November 4, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied as unnecessary as the appellant's assigned counsel made a timely motion for leave to appeal to the Court of Appeals, which was granted by order dated March 31, 2015.
