Appellant having moved, upon the return of an order to show cause granted by the Honorable Joseph D. Valentino on May 1, 2015, for a stay of all proceedings to enforce a warrant of eviction of the West Bloomfield Town Court dated August 27, 2014, pending the hearing and determination of the appeal taken herein from an order of the Ontario County Court entered in the Office of the Clerk of the County of Ontario on April 29, 2015,
Now, upon reading and filing the affirmation of Craig D. Chartier, Esq., dated May 1, 2015, the affidavit of JoEllen Petrillo sworn to April 15, 2015, said show cause order with proof of service thereof, the opposing affirmation of John Nacca, Esq., dated May 15, 2015, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied, and
It is further ORDERED that the temporary stay contained in the show cause order bringing the motion on before the full Court is vacated.
