| DECISION & ORDER ON MOTION |
Motion by the respondent Scenic Development, LLC, to dismiss an appeal from a judgment of the Supreme Court, Rockland County, dated September 10, 2012, for failure to comply with a decision and order on motion of this Court dated October 24, 2014, as amended February 10, 2015.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the appellant's time to comply with the decision and order on motion of this Court dated October 24, 2014, as amended February 10, 2015, is extended until July 17, 2015; and it is further,
ORDERED that no further enlargement of time shall be granted and the appeal will be dismissed, without further notice, if the appellant fails to comply with the decision and order on motion of this Court dated October 24, 2014, as amended February 10, 2015, on or before July 17, 2015; and it is further,
ORDERED that on the Court's own motion, the time of the respondent Scenic Development, LLC, to serve and file a brief is enlarged until August 17, 2015, and the brief of the respondent Scenic Development, LLC, must be served and filed on or before that date.
