| DECISION & ORDER ON MOTION |
Appeal by the defendant from an oral order of the Supreme Court, Nassau County, dated March 2, 2015. By order to show cause dated April 16, 2015, the appellant was directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the oral order is not appealable.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion is granted and the appeal is dismissed on the ground that the oral order dated March 2, 2015, is not appealable as of right and leave to appeal has not been granted, without prejudice to the appellant seeking any relief he may deem appropriate (see CPL 450.10; 450.15).
