| DECISION & ORDER ON MOTION |
Motion by the respondent to strike pages 78 through 82 and 92 of the appellant's appendix on an appeal, by permission, from an order of the Supreme Court, Kings County, dated March 26, 2014. Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, pages 78 through 82 and 92 of the appellant's appendix are stricken, and on or before July 7, 2015, the appellant shall remove those pages from the copies of the appellant's appendix filed with the Clerk of the Court or serve and file a replacement appellant's appendix which does not contain the stricken material; and it is further,
ORDERED that the application is granted, the respondent's time to serve and file a brief is enlarged until August 6, 2015, and the respondent's brief must be served and filed on or before that date.
