DECISION & ORDER ON MOTION

Motion by the appellant, in effect, pursuant to CPLR 5520(a) to extend the time to file a notice of an appeal from an order of the Family Court, Orange County, dated February 23, 2015, which was timely served, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is, in effect, pursuant to CPLR 5520(a) to extend the time to file a notice of appeal from the order dated February 23, 2015, which was timely served, is granted, and on or before July 20, 2015, the appellant shall file the notice of appeal with the clerk of the Family Court, Orange County, and file proof of service with this Court, or the appeal will be dismissed, without further notice; and it is further,

ORDERED that the branches of the motion which are for leave to prosecute the appeal as a poor person and for the assignment of counsel are denied with leave to renew on or before July 27, 2015, after the notice of appeal has been filed.
