Motion by Richard A. Schitt, Board of Zoning Appeals of Village of Kings Point, Planning Board of Village of Kings Point, Board of Trustees of Village of Kings Point, and Village of Kings Point for leave to appeal to this Court from an order and judgment (one paper) of the Supreme Court, Nassau County, entered April 21, 2015. Cross motion by LS Pheasant Run, LLC, inter alia, for an expedited briefing schedule and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as unnecessary as the order and judgment is appealable as of right (see CPLR 5701); and it is further,
ORDERED that the cross motion is denied.
