Appeal by Maria J. Varellas from an order of the Supreme Court, Nassau County, dated July 9, 2013. By decision and order on motion of this Court dated February 26, 2014, the appellant's time to perfect the appeal is enlarged until April 25, 2014, and the respondent's motion to dismiss the appeal on the ground that no appeal lies from an order denying reargument was held in abeyance. The appellant has not perfected the appeal.
On the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect the same in accordance with the rules (see 22 NYCRR 670.8[e]) and prior order of this Court; and it is further,
ORDERED that the respondent's motion is denied as academic.
