Defendant having moved and plaintiff having cross-moved for an extension of time to perfect the appeal and cross appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on October 14, 2014,
Now, upon reading and filing the affirmation of Catharine M. Venzon, Esq., dated July 10, 2015, the affirmation of AndrÉs D. Ortiz, Esq., dated July 20, 2015, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that defendant's motion is granted, and defendant shall perfect the appeal on or before September 15, 2015, and, in the event of failure to so perfect, defendant's appeal is hereby dismissed without further order, and
It is further ORDERED that plaintiff's cross motion is granted, and plaintiff shall perfect the cross appeal on or before September 21, 2015, and, in the event of failure to so perfect, plaintiff's cross appeal is hereby dismissed without further order.
