It is Ordered that defendant-appellant's motion for a stay of the release of funds and to vacate this Court's July 21, 2015 order that dismissed the appeal is granted. The appeal is reinstated and appellant's brief annexed to the motion papers herein is accepted for filing nunc pro tunc. Respondent's brief is to be served and filed by October 1, 2015. Reply brief, if any, is to be served and filed by October 9, 2015. This case has been calendared for the November 2015 term of this Court.
